When the first American constitution, the Articles of Confederation, became fully operative on February 2, 1781, there were 13 states. These states had been British colonies before they declared (both individually and collectively) their independence from Great Britain in 1776. No new states were established under the Articles of Confederation, which was soon superseded by a new constitution.The federal government began operations under the new frame of government on March 4, 1789. At the time, North Carolina and Rhode Island had not yet ratified the Constitution; but both ultimately did so. Article IV, Section 3, clause 1 of the Constitution grants to Congress the authority to admit new states into the Union. Most of the states admitted to the union after the original 13 have been formed within territories of the United States (that is, land under the sovereignty of the federal government but not part of any state) that were organized (given a measure of self-rule by the Congress subject to the Congress' plenary powers under Article IV, Section 3, clause 2 of the Constitution.In some cases, an entire territory became a state; in others some part of a territory became a state. In most cases, the organized government of a territory made known the sentiment of its population in favor of statehood, usually by referendums. Congress then directed that government to organize a constitutional convention to write a state constitution. Upon acceptance of that constitution, Congress has always admitted that territory as a state. The broad outlines in this process were established by the Northwest Ordinance (1787), which predated the ratification of the Constitution. However, Congress has ultimate authority over the admission of new states, and is not bound to follow this procedure. Six states established by Congress were never organized territories of the federal government (or part of one) prior to being admitted to the Union. The following table is a list the original 13 states plus these states and their respective dates of statehood. The original states are presented here in the order that each ratified the 1787 Constitution. The date of admission listed for each subsequent state is the official date set by Act of Congress.".
