He returned to private practice in Nevada in 1866 and was District Attorney of Storey County, Nevada from 1866 to 1869.Hillyer was a federal judge on the United States District Court for the District of Nevada. He was nominated by President Ulysses Grant on December 15, 1869 to a seat vacated by Alexander W. Baldwin and confirmed by the United States Senate on December 21, 1869. He received his commission the same day and served in that capacity until his death, in Carson City, Nevada.".
