Following the enactment of a treaty between Germany and the USA that clarified certain property rights of victims of Nazi persecution, descendants of von Mendelssohn-Bartholdy filed suit against the Museum of Modern Art in New York in an effort to recover the work. Rakoff ruled that Mendelssohn-Bartholdy had been forced to sell the painting by the Nazi Party. The Museum of Modern Art and the Solomon R. Guggenheim Foundation then sued the heir, Julius Schoeps.
