Specific to this case, it was held that writing original source code that results in a similar or an identical function to another program does not result in infringement of that program.Navitaire also confirmed the notion that an injunction would be granted only where it wasn't oppressive.The Navitaire Court's approach has been confirmed in other opinions. In the Court of Appeals' 2007 decision of "Nova Productions Limited vs. Mazooma Games Limited", the court held that under a program did not infringe on another where it produces similar results but has different underlying source code.".
