From 1932 to 1938, he was a trustee of the University of North Carolina, and was named to the state's Superior Court in 1937. Folger had served only two months as a judge when he resigned to serve on the Democratic National Committee; he was a member of the Committee from 1936 until his death in 1941. As a Democrat, he was elected to the 76th United States Congress in 1938 and re-election to the 77th U.S. Congress in 1940, but his second term was cut short by his death in a car accident in Mount Airy on April 30, 1941.
