He was a justice of the Supreme Court of Georgia from 1868 to 1875, again returning to private practice in Atlanta, Georgia from 1875 to 1882. On August 3, 1882, McCay was nominated by President Chester A. Arthur to a new seat on the United States District Court for the Northern District of Georgia created by 22 Stat. 47.
